Although Palaniswami enjoys the top position at in the party, Sasikala has left her nephew TTV Dinakaran, who was expelled by late Tamil Nadu Chief Minister J Jayalalithaa in 2011, as in-charge of the party as the Deputy General Secretary of AIADMK. With elections to the Tamil Nadu Assembly over four years away, it would be a big challenge for anyone who assumes the mantle of chief minister to steer the ship. The fear of facing the ballot will bind the AIADMK legislators, political analysts said.

Palanisamy will meet Governor Vidyasagar Rao on Tuesday evening and stake claim to form the government.

In a related development, AIADMK MP V. Maitreyan from the O. Panneerselvam camp is expected to meet Election Commission officials in the afternoon, on the validity of Sasikala's appointment as the general secretary of the party, which in turn will decide the legality of Sasikala's decisions as general secretary.

Prosecutors successfully argued that Sasikala and her mentor, former Tamil Nadu Chief Minister Jayalalithaa Jayaram, had possessed "disproportionate assets" that could not possibly have been obtained with their public salaries.

"Now with a 15-day window being given, certainly there are chances of big time horse trading happening for the goal of proving strength in the Assembly", he said. Along with him will be sworn in a 31 member cabinet. A section of the AIADMK MPs who declared their support to Panneerselvam is of the view that a split in the party at this hour of crisis is suicidal as well as detrimental. But some legislators claimed they were being held hostage, and said they were backing Mr Panneerselvam.

However, he will have to prove his majority on the floor of the Tamil Nadu Assembly after 15 days.

Sasikala loyalist and strongman of Salem, Edappadi K Palaniswami, has been elected as the AIADMK legislative party leader. The move was apparently aimed at projecting Palaniswami as the next chief minister since her conviction will prevent her from holding the executive post.

In 1987 after party founder MG Ramachandran's death, the AIADMK split into two factions - one led by Jayalalithaa and the other by MGR's wife Janaki.

Returning to the jail after 21-day stay from September 27 to October 18, 2014, as the apex court Tuesday upheld their conviction by the trial court, Sasikala had a hard time in the cell as she could not sleep and was said to be restless at night. Palaniswami held the PWD, highways and minor ports portfolios in the Jayalalithaa and Panneerselvam cabinets.
