Judge denies 'stand your ground' defense in movie theater slaying

He claimed he was protected by the "stand your ground" law in Florida which allows citizens to use lethal force if they feel they are in imminent danger of death or significant harm.

The physical evidence contradicts the defendant's version of events.

Reeves apparently instigated the conflict with Oulson over his texting during the previews to a movie, and it went downhill from there.

This matter came before the court during evidentiary hearing upon defendant's motion commencing on February 20, 2017, and heard through March 3, 2017. Reeves is facing a charge of second-degree murder.

Reeves is free on bond. Reeves and his wife, Vivian, were at the theater to see a matinee of "Lone Survivor".

Some details of the interaction between Reeves and Oulson are in dispute.

Richard Escobar, the attorney for Reeves, did not immediately return a call for comment. Oulson refused, prompting Reeves to seek out theater staff for assistance.

The hearing lasted multiple weeks with multiple witnesses testifying about what they saw during the argument between the men that ended with the shooting death of Oulson, 43. According to the retired police captain, Oulson threw popcorn at him and hit him in the head with a cell phone.

Oulson later died in hospital. Oulson was shot in the chest. It in fact suggests that Reeves played a role in both instigating the initial confrontation, and he then re-instigated it after he returned from speaking to the theater manager.

Barthle added: "In addition, common sense and the credible testimony of the medical examiner casts grave doubt on the likelihood of anything hitting the defendant in the eye beneath his glasses in the manner the defendant described". In her order, Barthle said Reeves' "testimony was significantly at odds with the physical evidence and other witness testimony". The defense has said Oulson stood to confront Reeves.

More than 1,100 days have passed since Curtis Reeves shot and killed Chad Oulson in a Wesley Chapel movie theater.
