California joins lawsuit against Trump's travel ban

California joins lawsuit against Trump's travel ban

Robart issued a restraining order against the initial ban, a ruling that was later upheld by the US 9th Circuit Court of Appeals.

Today: Ferguson files amended complaint asking Robart to extend the restraining order to stop the new travel ban.

Trump's new order, which is set to take effect on March 16, temporarily blocks the issuance of new visas to citizens of six Muslim-majority countries, and it suspends the US refugee program.

But the judge cited procedural reasons for not doing so.

"It's shocking because he's done a great job", said Blair Horner, the legislative director for the New York Public Interest Research Group.

Trump's counselor pointed to Iraq's removal from the revised list is a "great signal" as to how other nations, which are known to "harbor, train or export terrorists", can be removed from the ban.

While the new order contains changes, the basic legal problems remain, said Washington's attorney general, Bob Ferguson.

The letter argues that the revised ban "suffers from the same core substantive defects as the previous version."The revised executive order will jeopardise our relationship with allies and partners on whom we rely for vital counterterrorism cooperation and information-sharing". The man, who is not identified because of fears for his family's safety, filed a federal lawsuit in Madison in February alleging Trump's first travel ban had wrongly stopped the visa process for his family.

Ferguson filed new documents after a federal judge last week said he wouldn't immediately rule on whether his restraining order against the old ban applies to the new Trump executive order. The states may also try to go to the Supreme Court if their new challenges falter. But in January, after Trump's first order, she introduced two bills in Congress that she said were meant to prevent Trump from blocking entire categories of immigrants unilaterally.

The suit alleges that the new executive order violates the constitutional protection of freedom of religion in that it is "intended and created to target and discriminate against Muslims, and it does just that in operation". Trump supporters say the president is fulfilling his campaign promises to protect Americans.

California is the latest state to join a legal challenge to President Donald Trump's revised travel ban. And for 90 days, no new visas would be granted to travelers from Iran, Libya, Somalia, Sudan, Syria and Yemen. However, Iraq was taken off the list because of its cooperation with the U.S. on the fight against Daesh, officials said. After the initial Executive Order, thousands of immigrants were either unjustly blocked from entering the United States, had their visas revoked, or had their applications placed on hold.

Unlike the original order, the new one says current visa holders won't be affected, and it removes language that would give priority to religious minorities.
