North Carolina Introduces Bill to Outlaw Gay Marriage

North Carolina Introduces Bill to Outlaw Gay Marriage

However, Section 2 in the new law keeps in place the portion of the old law that permanently prevents all state agencies in North Carolina, including universities, local school boards, and other branches of government, from regulating "access to multiple occupancy restrooms, showers, or changing facilities, except in accordance with an act of the General Assembly".

Attorneys for the U.S. Justice Department filed a motion today to dismiss a lawsuit over House Bill 2 "in light of the passage of North Carolina Session Law 2017-4, House Bill 142". "HB2 was unconstitutional as of the moment it was enacted".

The new law, which is commonly referred to as House Bill 142, does a few notable things.

"It is clear that the days of a robust Civil Rights Division at the DOJ are behind us", Strangio said.

But as large cities and states across the nation reaffirmed their travel bans to North Carolina to take stands against LGBT discrimination, questions remain about the effect of the compromise law adopted in HB2's place.

The state lawmaker, famously known for being an advocate of the LGBTQ community, is "disgusted" by the Republican initiative to repeal a Federal decision known as the "Oberg fell v. Hodges decision of the United States Supreme Court of 2015" rendering it void on the state level.

Additionally, localities within the state are barred from passing any regulations or ordinances that provide protections to LGBTQ people in employment or non-restroom public accommodations until December 1, 2020. According to one recent estimate, the bill could cost North Carolina at least $3.7 billion over a 12-year period.

Given the NCAA and National Basketball Association were convinced to abandon their boycotts of North Carolina over its replacement law, it seems likely that Texas lawmakers expect their new plan will similarly be safer from economic backlash. The North Carolina state government was closed because of the Good Friday holiday.

The Justice Department's withdrawal represents the first significant movement in a tangle of legal action over the state's nondiscrimination laws since a deal last month to get rid of House Bill 2. "We will continue to fight for full, lived equality for LGBT North Carolinians".

HB142, passed March 30, was framed as a repeal of HB2. After that point, any city may add additional discrimination protections based upon gender identity, sexual orientation, or other characteristics. "We don't think the courts will have any trouble seeing that, regardless of who's sitting at counsel's table". "This move does not affect the merits of the case", she said. Each side is to file new arguments by late April to a court in which two of the judges recently described Gavin Grimm, the teen from Virginia fighting for transgender rights, as a courageous civil rights leader.
