Justices to review New Jersey bid for legal sports betting

Justices to review New Jersey bid for legal sports betting

In the appeal Governor Christie points to an earlier 1992 Supreme Court decision which said that the US federal government may not "commandeer" the regulatory powers of individual states, claiming that this infringes on state sovereignty, as laid out in the US Constitution.

"Justice Kennedy has a long track record of having a very liberating approach to free speech", said Richard Garnett, professor at the Notre Dame Law School and a First Amendment expert.

The legal fight broke out in 2012 when Phillips told gay couple David Mullins and Charlie Craig that due to his Christian beliefs, his store's policy was to deny service to customers wanting to purchase cakes to celebrate a same-sex wedding.

Justices Clarence Thomas and Neil Gorsuch said the court should have reviewed the appellate ruling. Is he going to discriminate against them? The couple planned to marry in MA and wanted a cake to celebrate in Colorado.

Masterpiece Cakeshop owner Jack Phillips was overcome with emotion when he learned the Supreme Court would take up his case. The case could now be heard as soon as this fall in the nation's highest court, which will have to decide if the 25-year-old Professional and Amateur Sports Protection Act (PASPA) is unconstitutional.

The court made its decision without requiring oral argument or additional briefing on the case. The bills would have prohibited punitive action against business owners for refusing service under religious beliefs as well as stopped the state from blocking the exercise of religion in most cases. "He chose to stop making wedding cakes", said Jeremy Todesco, a lawyer for the Alliance Defending Freedom, who appealed for Phillips on his behalf. It imperils everyone's freedom by crushing dissent instead of tolerating a diversity of views.

The state court said the birth certificate law did not violate the guarantee of equal protection under the U.S. Constitution because it was meant to record biological relationships, not marital ones.

"All hardworking people, including those who are gay, lesbian, bisexual, transgender, or queer, should be treated fairly and equally under the law", said Laura "Pinky" Reinsch, political director for the gay rights group One Colorado.

The justices on Monday left in place an appeals court ruling that upheld the San Diego sheriff's strict limits on issuing permits for concealed weapons.

Another Arkansas couple in the case was Leigh and Jana Jacobs who had a similar experience the when Leigh Jacobs gave birth to their son in 2015.
