Former New York Assembly Speaker Sheldon Silver's conviction in a multi-million dollar corruption case has been overturned.

Now, Reice said he's looking at whether the Court of Appeals, the state's highest court, will reconsider Taub's case given the ruling on Silver.

Kelly Kramer, a white-collar criminal defense attorney at the Mayer Brown law firm, said that Silver's conviction had always been considered "one of the most vulnerable" after the Supreme Court's decision on McDonnell.

Silver had been sentenced to 12 years in prison, and was forced to give up his Assembly seat.

Silver was once one of of the most powerful people in NY state politics - along with Gov. Andrew Cuomo and former Senate leader Dean Skelos.

The appeals court said because those jury instructions were wrong based on the McDonnell decision, the powerful NY lawmaker might have been convicted in error. Silver also allegedly profited from the arrangements.

In Silver's case, the court ruled his jury was given a too-broad definition of what constitutes an "official act" in light of the Supreme Court's decision, according to the ruling.

The key government witness who helped bring down Sheldon Silver is hoping the disgraced pol's overturned conviction will help him get his own job back. Bob McDonnell a year ago that narrowed the definition of the type of official conduct in a corruption prosecution case.

It should be noted that the appellate court's ruling still leaves the door open for prosecutors to retry Mr. Acting U.S. Attorney Joon Kim said Silver would be retried.

The U.S. Attorney's Office under Preet Bharara's leadership won its case, and we have every expectation that the people can win again at retrial.

"Though we reject Silver's sufficiency challenges, we hold that the District Court's instructions on honest services fraud and extortion do not comport with McDonnell and are therefore in error, " Judge Jose A. Cabranes wrote in the unanimous decision by the three-judge panel.

"The McDonnell decision can and is likely to play in Skelos's favor in a fashion similar to Silver's case", Kuby said.

"There is no doubt that this case is distasteful; it may be worse than that", Roberts wrote in an unpredictably unanimous decision past year.

Silver, who represented the Lower East Side in the New York State Assembly, faced years in prison following his 2015 conviction on corruption charges. Although it will be delayed, we do not expect justice to be denied, " the prosecutor said.

Silver was convicted of abusing his public position by engaging in two quid pro quo schemes in which he performed official acts in return for bribes and kickbacks, and that he put the proceeds of his schemes into private investment vehicles. He said, "As I have said, we must respect the judicial process".

More than 30 other state lawmakers have left office under a cloud of criminal or ethical allegations since 2000, including Silver's former state Senate counterpart, Republican ex-Majority Leader Dean Skelos. It is a pillar of our democracy.

After an appearance in Buffalo Thursday, Cuomo did not signal his personal view on the court's decision.
