Is it legal for Jerry Jones to bench players who don't stand?

What makes that gesture better than somebody else who might be praying during the national anthem?

"If there's anything that is disrespectful to the flag, then we will not play", Jones said after Sunday's loss to the Green Bay Packers.

Before the anthem of that game, players stood arm in arm with Jones, other front office executives, coaches and staff and took a knee. Two players, defensive linemen David Irving and Damontre Moore, raised fists at the end of Sunday's anthem.

A local labor union isn't seeing eye to eye with Jerry Jones due to his latest remarks. The union represents workers Texas, Arkansas and Louisiana.

"There's nothing that I've seen that shows the union that did file the [unfair labor practice] has any connection with the NFL Players Association, the NFL, or any particular player. Period", Jones said, according to the Dallas Morning News.

Wade Rathke, chief organizer of Local 100, said that Jones' threat violates the National Labor Relations Act of 1935, which allows employees "to engage in protected concerted activities for the objective of collective bargaining or other mutual aid or protection". "In other words, if you get arrested for DUI or arrested for a crime even though you weren't at work and it had nothing to do with work, an employer can fire you".

"They are proof that athletes like Colin Kaepernick who have quietly and peacefully used their platform to protest violence against communities of color do so at their own peril".

Dallas Cowboys owner Jerry Jones came out strong against the protests for black lives when he announced that any Cowboys player who kneels during the national anthem will be benched.

Following Jones making the policy public, NFL Commissioner Roger Goodell sent a letter to the NFL's 32 teams regarding a potential league-wide policy change in relation to the anthem. In the past, those protections have only protected people from being punished for belonging to certain political parties but a creative lawyer might try to argue it covers protesting football players, too, he said.
