Qualcomm sues Apple for breach of software license contract

The spat between Apple and chipmaker Qualcomm just keeps getting nastier and nastier, and apparently Apple may finally have had enough of it.

Next Qualcomm sues Apple, accusing them of failing to abide by their software license, and additionally of using their unprecedented access to Qualcomm to benefit rival Intel.

Although Apple doesn't use Snapdragon processors in its iPhones, it's still on the hook for numerous patents Qualcomm owns.

In its complaint to the ITC, Qualcomm asked the body to ban 'iPhones that use cellular baseband processors other than those supplied by Qualcomm´s affiliates'.

Qualcomm claim that Apple hasn't protected their software sufficiently, which they legally agreed to, and say Apple aren't allowing for a proper audit to review how the iPhone handles their software.

Qualcomm fires back at Apple supporters. It widened its suppliers to include Intel for some versions of the iPhone beginning with the 7 model.

Qualcomm alleged that in July, Apple emailed Qualcomm to request "highly confidential" information about how its chips work on an unidentified wireless carrier's network. Still, these results are a reflection of the toll that the legal battle between Qualcomm and Apple is taking.

The latest lawsuit, which was filed in California state court, comes days after Bloomberg had reported that Apple is designing the latest iPhones and iPads without Qualcomm parts.

In Qualcomm's earnings report yesterday, the chipmaker revealed that full-year QTL segment sales had fallen 16% due to Apple and another unnamed licensee withholding royalty payments.

In contrast, revenue from Qualcomm's licensing business fell 36 percent to $1.21 billion in the quarter ended September 24.
