Court denies Ezekiel Elliott appeal, suspension upheld

The emergency motion filed by the Cowboys running back's legal team was denied by the 2nd U.S. Circuit Court of Appeals.

The NFL handed down Elliott's suspension August 11 after a yearlong investigation into accusations of domestic violence in Ohio.

However, the one positive to Thursday's ruling is that he'll now be eligible to return on Christmas Eve in a Week 16 matchup with the Seattle Seahawks and can participate in the postseason if the Cowboys make it.

This is a developing news story.

The NFL Players Association has reportedly told ESPN that Elliott will not play "while we argue". A temporary stay was issued on November 3 as the NFLPA prepared this case, which allowed Elliott to play in Dallas' Week 9 victory over the Chiefs.

Ezekiel Elliott's on again, off again suspension is back on after a ruling Thursday afternoon. The collective bargaining agreement between the National Football League and NFLPA affords commissioner Roger Goodell the power to make decisions on suspensions.

Although Elliott faced no criminal charges from the case, the NFL probe found him to have been in breach of the league's personal conduct policy.

As a rookie last season, the former Buckeyes standout rushed for a league-leading 1,631 yards over the course of 15 regular-season games for the playoff-bound Cowboys.

A federal appeals court last month tossed out his court challenge in Texas, but the league's request for a NY court to affirm that it had acted properly led to a judge ruling last week that Elliott must begin his suspension.
