Brock Turner appeals sexual assault conviction, seeks new trial

Now, however, his lawyers have launched a campaign to have those convictions overturned, filing a motion that calls his 2016 trial "a detailed and lengthy set of lies".

The former Stanford University swimmer convicted a year ago of sexually assaulting an unconscious woman outside a campus fraternity party is appealing.

Turner's victim, styled Emily Doe in court papers, has never been publicly identified. He also received three years of probation and is required to register as a sex offender for the rest of his life.

Turner was convicted in June 2016 of three counts of sexual assault: assault with intent to commit rape of an intoxicated woman, sexually penetrating a woman with a foreign object, and sexually penetrating an unconscious woman with a foreign object.

The main key to Turner's request for a new trial is the statement the prosecutor was said to have made repeatedly made during trial, saying the assault occurred "behind the dumpster".

That characterisation of the crime, "implied an intent on the appellant's part to shield and sequester his activities" and "implied moral depravity, callousness and culpability on the appellant's part because of the inherent connotations of filth, garbage, detritus and criminal activity frequently associated with dumpsters", the document reportedly states.

According to CNN, Turner's attorneys have claimed that his conviction was "fundamentally unfair", and are pushing for a new trial in the hopes of fully exonerating him.

'His conviction will be upheld. "Nothing can ever roll back (the victim's) legacy of raising the world's awareness about sexual assault". In the appeal, the lawyers claim the assault did not occur behind a dumpster because the woman was found in a "completely open setting". However three months after Turner began his sentence, he was released from jail.

The case gained national attention when Judge Aaron Persky sentenced Turner to six months in jail.

The former Stanford University swimmer was arrested in 2015, aged 19, after he was seen on top of an unconscious woman outside a fraternity house during party.

Stanford law professor Michele Dauber, who is leading the recall effort, said the evidence against Turner was overwhelming.

Records show that Turner's legal team filed their appeal in California's 6th District Court of Appeal.
