Austria Court Legalizes Same-Sex Marriage

Same-sex couples in Austria will be able to legally marry from 2019 after a ruling by the country's top court.

This came after a complaint was made by two women to the Constitutional Court.

Although LGBTQ people in Austria have been able to enter into civil partnerships, the country's definition of marriage had been for "different sex" partners.

The current rules on marriage will remain in place until at least the end of 2018, unless Austria's parliament decides to legislate and change their marriage rules in the interim.

Same-sex couples in Austria, a predominantly Roman Catholic nation of some 8.7 million people, have been allowed to enter civil partnerships since 2010.

However, the Austrian Constintutional Court have examined and repealed that definition, saying that it was discriminatory against LGBTQ people.

Gay marriage has already been legalized in 15 countries in western Europe, including in Germany, which until this year was the biggest holdout.

In the December 4 ruling, the Constitutional Court argued that over the course of time, the differences between civil marriage and registered partnership have diminished.

The Constitutional Court said: 'The distinction between marriage and registered partnership cannot be maintained today without discriminating against same-sex couples'. However, in the state's laws on marriage it had been explicitly stated that only two people of the opposite sex could marry. The Australian House of Representatives is discussing the legislation this week.

In 2011, the Netherlands became the first country in the world to allow gay marriage, and more than a dozen European countries have since followed suit. Men who have sex with men are also not allowed to donate blood.

"Austria's constitutional court has sent a powerful message that when it comes to the legal status of relationships, separate is not equal", Dittrich said.
