Bill Cosby Goes to Court to Stop Accusers From Testifying

A jury deadlocked on the case a year ago.

Cosby, who sat silently through much of the rest of the hearing, quietly thanked the judge.

He hugged his defense lawyers, who aimed to convince Judge Steven O'Neill that Cosby would be denied a fair trial if the multiple accusers were permitted to take the witness stand in the retrial, slated to begin with jury selection on March 29.

The accusers are needed to show Cosby "systematically engaged in a signature pattern of providing an intoxicant to his young female victim and then sexually assaulting her when she became incapacitated", Assistant District Attorney Adrienne Jappe said.

His new defense team, led by Michael Jackson's former lawyer Tom Mesereau, had argued travel and phone records prove his alleged assault of Andrea Constand could not have occurred between December 30, 2003, and January 20, 2004, as she has claimed.

O'Neill of the Montgomery County Court of Common Pleas ultimately rejected the motion to dismiss and said the issue should be addressed at trial.

Cosby is facing a retrial on sexual assault charges stemming from an alleged 2004 attack on Andrea Constand - the former director of operations for the women's basketball team at Cosby's alma mater, Temple University. Prosecutors have put forth a list of 19 women, including model Janice Dickinson, whom they would like to call to the stand - six more than they sought in the first trial and 18 more than O'Neill allowed at the time. He insisted that no notes were taken during his office's interview with Jackson and said prosecutors had any number of reasons to doubt her testimony - chiefly, that Cosby has admitted to having a past sexual liaison with Constand. "If it was a large settlement, why did Cosby pay such a large settlement for something that he says didn't happen?" Judge O'Neill did not allow numerous prosecutor's proposed witnesses to testify, and he forbid any mention of the nearly 60 other women who had publicly accused him of sexual misconduct in the past 50 years.

The lawyers also said they've unearthed evidence showing the embattled comedian, who's been accused by some 60 women of sexual misconduct, drugging, and even rape, wasn't in the state at the time.

Each alleged victim, she said during a pretrial hearing ahead of the April 2-starting trial in Norristown, PA, was younger than Cosby, a lot of them by at least 10 years.

Even before Monday's arguments got underway, Cosby's lawyers were rapped by the judge for falsely accusing prosecutors of hiding or destroying evidence.

Steele said Cosby's lawyers wrongfully claimed the prosecution defied court orders and attempted to suppress a deposition.

Any incident that occurred prior to December 30, 2015 would fall outside Pennsylvania's 12-year statute of limitations.

Each time, Cosby initiated the first contact, built a trusting relationship and, when the alleged assaults occurred, invited them into an environment he could control.

During the hearing, O'Neill repeatedly reminded the court that this is a new trial for Cosby, whose June trial for the same charges ended in a mistrial.

Prosecutors argued the lawyers acted recklessly by making the false claim.

Monday's hearing comes less than two weeks after the death of his 44-year-old daughter from kidney disease. The judge, though, did leave open the possibility that he might allow Ms. Jackson to testify at the retrial.

But defense lawyer Kathleen Bliss asked O'Neill to reconsider that ruling Monday.

Defense attorney Rebecca James disputed Constand's testimony that she was assaulted sometime in January 2004, saying the time was inconsistent with her travel and communications records.
